Who we are

Resonant DSP Inc. is a company incorporated in Ontario, Canada, and trades as Resonant DSP. In these terms, “Resonant DSP”, “we” and “us” mean that company, and “you” means the person who buys or uses Swanky Amp Pro.

Agreeing to these terms

By buying, installing or using Swanky Amp Pro, including the demo, you agree to these terms. They are the licence agreement for the plug-in. If you don't agree to them, don't install it.

Buying through Paddle

Paddle.com is the reseller and merchant of record for every Swanky Amp Pro order. You buy the licence from Paddle, and we license the software to you under these terms. Paddle takes the payment, charges any sales tax, sends your receipt and answers billing questions. Its buyer terms cover the purchase itself.

The checkout shows the final price, currency and tax before you pay. Once the payment goes through, we email your product key to the address you gave at checkout.

Your licence

When you buy Swanky Amp Pro, we give you a personal licence to install and run it on up to three computers you use. The licence does not expire, and it includes updates to version 2 at no extra charge.

The music you make with it is yours. You can record, mix, release and perform with Swanky Amp Pro, for money or not, and you owe us no credit or royalty.

Swanky Amp Pro belongs to Resonant DSP and its licensors. The licence gives you the right to use the software, not ownership of it.

Activation

The first time Swanky Amp Pro runs on a computer, it asks for your product key and checks it with our server over the internet. After that it works offline on that computer. Activating again on the same computer doesn't count as another one.

If you replace a computer and run out of activations, write to support@resonantdsp.com. The privacy policy says what an activation sends.

The demo

Without a product key, Swanky Amp Pro runs as a demo. The demo is the full plug-in with no time limit, except that it goes silent for five seconds once a minute. The limits below apply to the demo too.

What you may not do

Don't share or publish your product key, or use it on more than three computers.

Don't copy Swanky Amp Pro for anyone else, or sell, rent, lend or pass it on, without our permission. If you want to give your licence to someone else, write to support@resonantdsp.com.

Don't change the plug-in to get around the licence check or the demo's silences, and don't share anything that does.

Swanky Amp Free

Swanky Amp Free is free, open-source software under the GNU General Public License, version 3 or later. That licence, not these terms, sets what you can do with it.

Refunds

The refund policy explains how to get your money back within 30 days and what happens to the licence.

When the licence ends

The licence ends if you are refunded in full, if your payment is reversed through your bank, or if you seriously break these terms, for example by publishing your product key. When it ends, the key can no longer activate any computer, including one it activated before.

When your licence ends, stop using Swanky Amp Pro and uninstall it.

Warranty

Apart from the guarantees the law gives you, Swanky Amp Pro is provided “as is”. We don't promise that it works with every host, computer or setup, or that it is free of bugs.

Limits on our liability

If something goes wrong, the most we are responsible for is what you paid for the licence. We are not responsible for indirect losses, such as lost work, lost income or a missed session.

These limits don't apply where the law doesn't allow them, such as to fraud, or to death or personal injury caused by negligence. Nothing in these terms takes away a right that the law where you live says can't be taken away, such as a consumer guarantee.

Using this site

The text, pictures and recordings on this site, and the names of our products, belong to Resonant DSP, except the reviews we quote, which belong to their authors. You are welcome to link to any page. The press page says how to use the logo and product pictures.

Other companies' product names that appear here belong to their owners, who are not connected with Resonant DSP. We use them only to describe a sound.

Which law applies

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. If you buy as a consumer, you also keep the protection of the law where you live.

If a court decides that part of these terms can't be enforced, the rest still applies.

Changes to these terms

We may update these terms. When we do, we change the date at the top of this page. The terms in place when you bought apply to that purchase.
